In accordance with Article 40 § 4 of the Act of 14 June 1960 – the Code of Administrative Procedure (i.e. Journal of Laws of 2021, item 735, as amended) "A party who is not domiciled or does not reside in the Republic of Poland, another Member State of the European Union, the Swiss Confederation or a Member State of the European Free Trade Agreement (EFTA) - a party to the Agreement on the European Economic Area, if it has not established a representative for the conduct of the case residing in the Republic of Poland and does not act through the consul of the Republic of Poland, is obliged to appoint in the Republic of Poland a representative for delivery, unless the delivery is made by electronic means of communication."
